Promotions, discount codes, influencer codes, ambassador codes, event offers, free-shipping offers, and similar promotions may be subject to additional conditions.

Unless expressly stated otherwise:

• promotional offers have no cash value;
• only one promotional code may be used per order;
• promotions may not be combined;

Bombshell may modify or terminate promotions prospectively, subject to applicable law.

Bombshell currently ships to eligible addresses within the United States unless otherwise stated at checkout.

Available shipping methods, charges, and estimated delivery windows are displayed during checkout or in our Shipping & Returns Policy.

Shipping and delivery estimates are estimates rather than guarantees unless expressly stated otherwise.

Delays may occur because of:

• carrier delays;
• weather;
• holidays;
• address problems;
• high-volume periods;
• governmental actions;
• supply-chain interruptions; or
• other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

Returns, refunds, replacements, damaged products, incorrect shipments, and other order-related remedies are governed by Bombshell's current Shipping & Returns Policy.

Nothing in these Terms limits any non-waivable consumer remedy provided by applicable law.

Products are offered subject to availability.

Displaying a product on the website does not guarantee continued availability.

Except for personal, non-commercial use of the Services, you may not copy, reproduce, modify, republish, distribute, sell, license, publicly display, create derivative works from, or commercially exploit Bombshell content without prior written authorization.

Nothing in these Terms grants ownership of any Bombshell trademark, copyright, trade dress, or other intellectual property.

If you voluntarily tag Bombshell, mention Bombshell, submit content to Bombshell, participate in a Bombshell campaign, or otherwise provide photographs, videos, comments, reviews, testimonials, or other content (“User Content”), you retain the ownership rights you otherwise have in that content.

Bombshell will not treat a simple public tag or mention, by itself, as an unlimited transfer of ownership.

If we wish to use User Content in advertising or other commercial marketing beyond platform-native sharing or functionality reasonably associated with the user's action, we may request additional permission where appropriate.

You represent that User Content you intentionally submit directly to Bombshell:

• is yours or you have permission to provide it;
• does not infringe third-party rights;
• is truthful based on your own experience where it contains a testimonial or endorsement; and
• does not contain unlawful or deceptive content.

We may remove User Content from Bombshell-controlled Services at our discretion, subject to applicable law.

Applying to Bombshell's ambassador, affiliate, creator, or influencer program does not guarantee:

• acceptance;
• payment;
• commissions;
• free products;
• promotional opportunities; or
• continued participation.

Separate program terms or agreements may apply to accepted participants.

Anyone with a material connection to Bombshell—including receipt of free products, commissions, compensation, discounts, or other benefits—must disclose that relationship clearly and conspicuously when endorsing Bombshell.

Ambassadors and creators may not make unauthorized claims concerning Bombshell products.

Any reviews, testimonials, endorsements, or customer statements displayed by Bombshell should reflect genuine experiences and must not be interpreted as guarantees that another customer will experience identical results.

Bombshell may moderate content to address spam, unlawful material, irrelevant content, or violations of published review rules but will not knowingly create or present fabricated customer reviews as genuine consumer experiences.

You may not use the Services to:

• violate applicable law;
• commit fraud;
• provide false purchase information;
• interfere with website security;
• introduce malware or harmful code;
• scrape or harvest data through unauthorized automated means;
• impersonate another person;

Bombshell is not responsible for the content, security, privacy practices, or availability of independent third-party websites or services except to the extent required by applicable law.

Where applicable, consumers may also access Your Privacy Choices and Privacy Request through the links provided on the website.

The Privacy Policy is incorporated into these Terms by reference.

We seek to maintain reliable Services but do not guarantee that the website will always be:

• uninterrupted;

• available;
• secure from every possible threat; or
• compatible with every device.

We may modify, suspend, maintain, upgrade, or discontinue portions of the Services when reasonably necessary.

THIS SECTION DOES NOT LIMIT RIGHTS OR WARRANTIES THAT APPLICABLE LAW DOES NOT PERMIT US TO DISCLAIM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHELF SELECT, LLC, BOMBSHELL VITAMINS, AND THEIR AFFILIATES, OFFICERS, MANAGERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES.

TO THE EXTENT PERMITTED BY LAW, LIABILITY ARISING FROM AN ECOMMERCE TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO BOMBSHELL FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING RIGHTS OR REMEDIES THAT APPLICABLE CONSUMER-PROTECTION OR PRODUCT-LIABILITY LAW MAKES NON-WAIVABLE.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this Section may not apply to you.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Shelf Select, LLC and Bombshell Vitamins from third-party claims, liabilities, losses, and reasonable costs arising directly from:

• your material violation of these Terms;
• your unlawful use of the Services;
• User Content you intentionally submit that violates another person's rights; or
• your violation of applicable law through use of the Services.

This provision does not require a consumer to indemnify Bombshell for Bombshell's own negligence, unlawful conduct, defective products, or other liability that cannot lawfully be shifted to a consumer.

Bombshell will not be responsible for delay or failure in performance caused by circumstances beyond its reasonable control, including:

• natural disasters;
• severe weather;
• labor disruptions;
• transportation interruptions;
• governmental orders;
• public-health emergencies;
• cyberattacks;
• carrier failures;
• utility or internet outages;
• supply-chain interruptions; or
• similar events,

except that this Section does not eliminate refund or other consumer rights that applicable law requires.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or non-waivable law of another jurisdiction applies.

Unless applicable law provides otherwise, any court proceeding arising from these Terms or the Services shall be brought in a court of competent jurisdiction located in Broward County, Florida.

Nothing in this Section deprives a consumer of any venue, small-claims remedy, or other right that cannot lawfully be waived.

These Terms do not require mandatory arbitration unless Bombshell later adopts a separately reviewed arbitration provision.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent legally permitted or severed as necessary.

The remaining provisions will continue in effect.

Bombshell's failure to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only as to the specific matter for which it is given.

These Terms, together with policies expressly incorporated by reference, constitute the agreement governing your use of the Services and purchases from Bombshell, except where a separate written agreement expressly applies.

Separate terms may govern ambassador programs, wholesale accounts, contests, subscriptions, or other future services.

We may update these Terms to reflect changes in:

• payment or shipping practices;
• technology;

• applicable law.
